In the letter written by Congress General Secretary Jairam Ramesh and other Congress leaders, it was said that the Election Commission's reply has been written in an insulting tone. If the Election Commission continues to use such language, the party will have no option but to seek legal recourse for such comments.
The Election Commission has given itself a clean chit. We do not know who is advising the Commission, but it seems that the Commission has forgotten that it is a body established under the Constitution.
Earlier, the Election Commission had rejected the Congress' complaint on October 29. In its 1600-page reply, the EC had termed the allegations as baseless, false and baseless.
Election Commission had said – unrest and anarchy may arise
The Election Commission had said in its reply, 'Making irresponsible allegations during sensitive times like voting and counting can lead to unrest and anarchy. Citing 5 cases in the last one year, the Commission advised the Congress party to be careful in making allegations and avoid habitually attacking the electoral operation without any evidence.
Voting was held in one phase in the state i.e. on 5th October and the results came on 8th October. During the counting of votes, Congress had complained to the Election Commission that some EVMs were working at 99 per cent battery capacity, while some were working at 60-70 and less than 80 per cent battery capacity.
Congress had complained on October 13, alleging rigging.
A party of Congress had reached the Election Commission on 13 October. In the one-hour meeting, allegations of irregularities were made on 20 seats.
Congress had complained to the Election Commission on October 13 claiming EVM malfunction in Haryana elections. Congress leader Pawan Kheda had said that during the counting of votes on 20 seats, irregularities were found in EVMs. Candidates for these seats had filed written and oral complaints. Congress has sent their list to the Election Commission. Kheda had said that it is strange that Congress candidates have lost on the same seats in which the machines had 99% battery charge. At the same time, the machines with 60-70% battery charge are the ones on which Congress candidates have won. On the day of counting, some machines were 99% charged and the rest of the normal machines were 60-70% charged. Our demand is that those machines should be kept sealed and safe until the investigation is completed.
Haryana Congress had also filed a petition in the Supreme Court Congress leaders Priya Mishra and Vikas Bansal had filed a petition in the Supreme Court on October 16 alleging irregularities in voting-counting on 20 seats. However, on October 17, the court also rejected it. It was said in the petition that the Election Commission has conducted elections in Haryana using EVM. Results have also been declared on the same basis. But, some EVMs were working at 99% battery capacity, while some were working at 60-70 and less than 80% battery capacity. The petitioners said that some EVMs had 99% battery even on the day of counting.
