The petition of former Delhi Chief Minister Arvind Kejriwal in the liquor policy case will be heard in the Delhi High Court today. Kejriwal had filed a petition on Wednesday (November 20) challenging the trial court's decision.
Kejriwal argues that the lower court has made a mistake in taking cognizance of the crime without any prior sanction. In such cases, prior approval of the Governor is necessary under Section 197 (1) of CrPC, because at that time he (Kejriwal) was holding the post of CM.
Kejriwal is currently out on bail. Two investigating agencies (ED and CBI) have registered a case against him. Kejriwal was granted bail by the Supreme Court in the CBI case on September 13. At the same time, in the ED case, he got bail from the Supreme Court on July 12.
ED had arrested him on March 21 in the liquor policy case. Later on June 26, CBI took him into custody from jail.
